Peak Athlete LLC ("Peak Athlete," "we," "our," or "us") provides swimming performance analysis services through our website mypeakathlete.com and our Peak Athlete mobile application (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use the Service.
By using the Service, you agree to the collection and use of information in accordance with this Policy.
1. Information We Collect
1.1 Information You Provide

Account information: email address, password (hashed), first/last name, role (athlete or coach), gender (optional)

Team information: team membership, team-level groups

Subscription information: payment is processed by Stripe (web) or Apple/Google (mobile). We do not store your full credit card or banking information. We receive a payment confirmation with a transaction ID and subscription status.

Race videos and session files: videos you upload for analysis, along with metadata (event date, distance, stroke, lane, optional notes)
1.2 Information Collected Automatically

Performance metrics: when our analysts process your uploaded video, derived data is stored — split times, stroke rates, stroke counts, reaction times, velocities, kick rates, and similar swim-performance fields

Usage data: which pages you visit, which features you use, device type and operating system (used solely to improve the Service — we do not sell or share usage data)

Authentication data: session tokens managed by our auth provider Supabase

We do not access your device camera, microphone, or contacts unless you explicitly upload a video file from your device

We use your information to:

Provide the Service — deliver race analyses, surface metrics, generate leaderboards, support coach/athlete relationships

Process payments and manage subscriptions

Send service-related emails (analysis ready, password reset, account changes)

Generate anonymized, de-identified benchmarks and statistics for the Service. Anonymized data cannot be linked back to you and is used to improve our analysis algorithms and create comparison cohorts (e.g. "average 100-free time across our user base").

Comply with legal obligations and enforce our Terms of Service
We do not sell your personal information to third parties.
3. How Information Is Shared
We share information only with:

Apple App Store / Google Play Store — payment processing for mobile subscriptions

RevenueCat — subscription state management for mobile (only metadata about subscription status, no personal data beyond a pseudonymous user identifier)

Resend — transactional email delivery (analysis ready, password reset)

Anthropic — AI Coach feature (Pro users; queries and responses are processed but not retained for training by Anthropic per their enterprise terms)
All service providers are bound by data processing agreements that prohibit them from using your data for any purpose other than delivering services to us.
3.2 Coaches and Teams
If you are an athlete on a team, your performance data is visible to the coaches of that team. This is the core function of the Service. Cross-team visibility is opt-in only, controlled by your participation in the global Competition leaderboards.
3.3 Legal Requirements
We may disclose information if required by law, valid legal process, or to protect our rights, the safety of our users, or the public.
3.4 Business Transfers
If Peak Athlete is acquired or merges with another company, your information may be transferred to the new entity. We will notify you of any such change.
4. Data Storage and Security

Where data lives: Supabase (US-based, AWS-hosted), Cloudflare R2 (global edge, US primary)

Encryption: all data is encrypted in transit (TLS) and at rest (AES-256)

Access controls: Supabase Row-Level Security ensures that users see only their own data and data shared with them by their team/coach

Retention: active account data is retained as long as your account is active. Upon account deletion, personal data is removed within 30 days.
We use industry-standard security practices but cannot guarantee absolute security. No method of electronic transmission or storage is 100% secure.
5. Your Rights and Choices
You have the following rights regarding your personal information:

Access — request a copy of your data

Correction — request corrections to inaccurate data

Deletion — request permanent deletion of your account and associated data (videos, metrics, sessions)

Portability — receive your race / start / turn data in a portable format (CSV/JSON)

Opt-out of benchmarks — request that your data be excluded from anonymized benchmark calculations

Withdraw consent — close your account at any time

5.1 Children's Privacy (COPPA)
Peak Athlete is intended for users 13 years of age and older.

Users under 13 may use the Service only with verified parental or guardian consent obtained directly from the parent/guardian.

Parents/guardians may review, request deletion of, or refuse further collection of their child's information by emailing eric@mypeakathlete.com.

We do not knowingly collect personal information from children under 13 without verified parental consent. If we learn we have, we will delete it.
5.2 California Privacy Rights (CCPA)
If you are a California resident, you have the right to know what personal information we collect, use, and share, and the right to request deletion. You also have the right to opt out of "sales" of personal information — note that we do not sell personal information.
5.3 European Privacy Rights (GDPR)
If you are in the European Economic Area, UK, or Switzerland, you have rights under GDPR including access, rectification, erasure, restriction of processing, data portability, and objection. The legal basis for processing your data is performance of a contract (delivering the Service you signed up for). To exercise GDPR rights, contact eric@mypeakathlete.com.
6. Cookies and Tracking
The Service uses minimal cookies, only for:

We do not use third-party advertising cookies or cross-site tracking.
7. Mobile App Permissions
The Peak Athlete mobile application may request the following device permissions:

Storage / Files — to upload race videos for analysis

Notifications (optional) — to alert you when an analysis is complete
The app does not request camera, microphone, location, contacts, or any other sensitive permissions.
8. International Data Transfers
If you access the Service from outside the United States, your data may be transferred to and processed in the US. By using the Service, you consent to this transfer.
9. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent change. Material changes will be communicated via email and through the Service. Continued use of the Service after a change constitutes acceptance of the updated Policy.

Welcome to Peak Athlete
Before using our services, please review and accept our Terms of Service and Data Use Agreement. By using Peak Athlete, you agree to these terms.
1. Acceptance of Terms
By accessing or using Peak Athlete services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Service Description
Peak Athlete provides swimming performance analysis services, including video analysis, split times, stroke metrics, and related analytics. Our services are intended for educational and performance improvement purposes only.
3. User Accounts

You must provide accurate and complete information when creating an account.

You are responsible for maintaining the security of your account credentials.

Peak Athlete is intended for users 13 years of age and older. Users under 13 may use the service only with verified parental or guardian consent obtained directly from the parent/guardian. Users aged 13–17 must have parental or guardian consent and acknowledgment of these terms. Parents may request data deletion for minors at any time by emailing eric@mypeakathlete.com.

4. Data Collection & Use
By using Peak Athlete, you authorize us to collect and process:

Video/imagery (above-water and underwater)

Performance metrics (splits, start/turn metrics, stroke data, velocities)

Session metadata (date/time, event type, equipment settings)

Analysis notes and derived metrics
We use this data to: (i) deliver analysis services; (ii) create anonymized benchmarks and comparisons; (iii) improve our software and algorithms; (iv) generate de-identified statistics and insights.
4.5 Your Data Rights
You have the right to:

Delete — request that we permanently delete your account and all associated data (videos, metrics, sessions)

Export — receive a copy of your race / start / turn data in a portable format

Submit any of these requests to eric@mypeakathlete.com. We respond within 30 days.
Account deletion removes all personal data within 30 days. Anonymized, de-identified statistics derived from your data may be retained.
5. Data Sharing
We may share your data with confidential, contract-bound service providers (cloud storage, video processing) and technology partners (including Contemplas) only as necessary to provide our services. Recipients may not use data for marketing, sell it, or disclose it except to perform their limited functions.
6. Payment Terms
Web purchases (subscriptions purchased through our website or directly via Stripe) are non-refundable. To cancel, use the customer portal link in your account. Subscription fees are billed in advance on a monthly basis. You may cancel your subscription at any time; access continues until the end of the billing period. Purchased analysis credits never expire.
iOS purchases made through the App Store are governed by Apple's Standard EULA and the Apple Media Services Terms and Conditions. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Cancellation, refund requests, and payment-method changes are managed through your iOS device's Settings → Apple ID → Subscriptions.
Android purchases made through Google Play are governed by Google Play's Terms of Service. Manage subscriptions at play.google.com/store/account/subscriptions.
7. Service Limitations

Services are provided "as-is" without warranty of any kind.

We do not guarantee uptime, accuracy, or specific performance outcomes.

Our analysis is not medical advice and is not a substitute for professional coaching.

We are not liable for training decisions made based on our analysis.
8. Account Termination
Peak Athlete reserves the right to suspend or terminate accounts at our discretion.
Upon termination — whether by you or by Peak Athlete — your account and personal data are deleted within 30 days. Video files are permanently removed from our storage. Anonymized statistical data may be retained for product improvement and benchmark calculations. You can export your data before requesting deletion.
9. Intellectual Property
Peak Athlete retains ownership of all software, analysis methods, algorithms, benchmarks, and derived datasets. You retain ownership of your original video content.
10. Indemnification
You agree to indemnify and hold harmless Peak Athlete from any claims arising from your use of the service, violation of these terms, or infringement of any third-party rights.
11. Limitation of Liability
To the maximum extent permitted by law, Peak Athlete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
12. Governing Law
These terms are governed by the laws of the State of Florida, Broward County, without regard to conflict of law principles.
13. Changes to Terms
We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
